Martin heads up the firm's real estate disputes team. He is an experienced property litigator and advises on a wide range of disputes whether in relation to freehold or leasehold property.
Typical cases include property management disputes under commercial leases (for example ’54 Act renewals, termination of leases, rent recovery and dilapidations) and issues associated with the development of land (for example nuisance, trespass and rights of way).
Martin also handles claims against surveyors and solicitors for professional negligence concerning property. He deals with all aspects of the management of these sorts of dispute, whether preliminary advice to try to avoid disputes arising, pursuing formal action through the Courts, or handling alternative forms of dispute resolution such as mediation.
Cases on which Martin has advised recently include acting for a public authority in its successful defence to a high value trespass action in the High Court concerning alleged trespass at a quarry/landfill site; advising a multinational firm of accountants as to their repairing and other obligations on a substantial landmark Midlands office building. Clients include private and public quoted companies; universities and colleges; public authorities; landed estates; pension funds as well as private individuals.
