We know how to deal with a complete range of pensions, offering
advice which is enhanced by its ability to draw upon specialist
help from our employment, tax
and commercial disputes management teams.
We have been established for some 16 years and are legal advisers
to 30 or more schemes. In the last 12 months alone, we have handled
the pensions aspects of more than 45 corporate transactions. Our work includes:
- drafting trust deeds and rules, together with amending schemes
to bring them up to date following the Pensions Act 1995
- mergers of schemes
- adopting the paperwork required by the Pensions Act 1995 - in
particular, letters of appointment of actuaries, investment managers,
custodians and auditors
- litigation, including seeking court approval on distribution
of surpluses and defending equal access claims in Industrial Tribunals
- documentation for funded and unfunded executive top-up schemes
- arrangements for overseas employees
- pensions aspects of corporate deals, including MBOs, MBIs, owner-managed
businesses, partnerships and educational institutions
- advising on trust/pensions law legislation and the exercise
of trustees' discretion
- advising receivers and liquidators on their powers in relation
to pension schemes in insolvency cases, including the exercise
of employers' lien clause
- switching from insured to self-administered schemes
