Our Capital Projects Group advises on major capital projects in all sectors but primarily in: Education Student accommodation PFI and PPP projects: Typically, but not always, such projects will involve the development or redevelopment of land owned by the education establishment. The education establishment will grant a long lease to the private sector partner who will provide the student residences. The university or college will have nomination rights for its students and the private sector partner will maintain the premises and provide facilities management services for a period of up to 30 years. The education establishment may take demand risk or it may not, but it will usually guarantee the rents for students who are nominated by it to the residences and who have signed a tenancy agreement. Recent experience includes:
- University of Wales, Aberystwyth in relation to the transfer of a student village to a private sector contractor for a significant premium
- University of Wales, Aberystwyth in relation to a nominations agreement with a developer for student accommodation
- Stratford-upon-Avon College in relation to new build student accommodation
- University of Plymouth on refurbished and new build student residences and academic accommodation
- University of Birmingham, taking education and research facilities in the Birmingham Hospitals PFI project
- North Nottinghamshire College, taking sixth form facilities in the Bassetlaw Schools PFI project
- University of Coventry in relation to a nominations agreement for new build student residences
Schools PFI projects Most PFI projects will now be carried out under the Building Schools for the Future initiative, but our Capital Projects Group has a wealth of experience in acting for the public sector and private sector on PFI schools projects. Recent experience includes:
- the first Birmingham Schools Grouped Schools Project
- the Bromsgrove Grouped Schools Project
- advising the Governors of the schools involved in the joint Worcestershire County Council/Wolverhampton ICT PFI project
- in addition, our lawyers have advised contracting authorities, contractors and funders on numerous other schools PFI projects
Health The health sector continues to require significant investment to improve facilities and overall service provision to meet Government targets and patient aspirations. Out team advises on construction and PFI projects in the health sector. Recent experience includes:
- Advising the construction contractor on the 3Shires batched hospitals PFI project
- Advising the construction contractor on the Queen’s Medical Centre DTC project
- Advising the construction contractor on 2 LIFT projects
- In addition our lawyers have advised bidders on a number of health projects, including medical equipment PFI projects
Transport Public transport infrastructure is set for massive investment. Members of our team have recently advised on: Regeneration We have worked for many years with public and quasi-public sector bodies engaged in regeneration and economic development. We also act for public bodies and numerous universities and further education colleges, a significant number of whom are embarking on major capital projects of a regenerative nature - new campus projects, learning quarters and similar - with funding support from a blend of public and private sources. Recent experience includes:
- Lead legal advisers on an urban village in Bilston.
- The housing-led regeneration scheme in north Solihull involving housing refurbishment, demolition and new build market housing.
- A housing market renewal scheme falling within the Manchester Salford Housing Market Renewal Pathfinder.
- A contractual joint venture between Warwickshire County Council and private developers to facilitate the regeneration of land at south west Warwick.
- Acting for a University which is leading a joint venture with two FE Colleges, a metropolitan authority and a Neighbourhood Renewal partnership for the site assembly and development of a university quarter, with funding support from the RDA.
