sport & leisure The close association between solicitors and golf clubs is almost
a cliché, born of repeated appearances of country solicitors
in their diamond-checked sweaters but otherwise very conservative
dress on the golf course during the afternoon in numerous sitcoms
in years gone by, putting the country solicitor, at least, firmly
in the "gin and Jag set". Whatever the reality of the
history, Martineau are heavily involved in the "golf
industry" both here and abroad as an interesting part of our
everyday practice.
Over the years Martineau has developed a specialist expertise
in relation to advice to golf clubs, their proprietors, purchasers
and sellers. In recent years we have been involved in the acquisition
of numerous prestigious clubs including Harleyford, The Bentley
and West Chiltington. we have been involved
in the development of leisure complexes including golf courses overseas,
eg in Cuba, Spain and the United States. We are currently working
on numerous further acquisitions and disposals.
The development of this expertise over the years has given rise to the creation of a focused industry-specific team of lawyers who are familiar with the issues that are liable to prove material. These include many which can arise in relation to a variety of acquisitions (for example health and safety at work, environmental concerns, hotel operation issues, vendor warranty questions and planning) but frequently extend to others which are absolutely fundamental to the successful operation of a golf course including the rules relating to water abstraction. Working in close cooperation with our friends at Property Golf
& Finance Limited, we have, on numerous occasions implemented
a "unitisation" scheme to facilitate the purchase of a
proprietary club by its members at a cost to the individual members
no greater than their projected golfing subscriptions.
